Daniel J. Smola specializes in U.S. and international patent preparation and the prosecution of utility and design applications, with patent drafting experience in a variety of industries, including: marine, commercial flooring, medical device, professional tool, household product, and fiber reinforcement composites, among others. He is experienced in the preparation of license, transfer, purchase, trademark co-existence, and settlement agreements for patents, trademarks and domain names, and in as conducting patentability and trademark clearance searches and preparing related opinions.

Within trademark protection, Dan has drafted and prosecuted numerous trademark applications, both in the U.S. and internationally. He is experienced with the prosecution of trademark opposition and cancellation proceedings, including preparing and filing various motions and briefs and conducting discovery. Furthermore, Dan provides daily counseling with corporate general counsel, corporate management and foreign associates, and holds meetings with inventors to determine the scope and patentability of inventions, with a strong focus on determining the value of the intellectual property. He is responsible for overseeing the management of clients’ intellectual property portfolios, the development and the implementation of offensive and defensive IP strategies and conducting IP due diligence for mergers and acquisitions.
