We have wide-ranging capabilities in the following areas:

Market leading class action defense practice. Our team has extensive experience in trying class actions with jury and bench trials. We have successfully defended over 100 consumer class actions over the last decade involving over $3 billion in alleged damages. Our experience defending class actions includes class-action lawsuit trials, eliminating proposed class actions on the merits prior to the certification decision, successfully opposing class-certification motions, decertifying previously certified classes, negotiating settlements of class claims, and obtaining necessary court approval of class settlements.

Outstanding appellate experience. Our team not only litigates matters in the trial courts, but we also have the appellate experience to develop compelling briefs in oral argument in the courts of appeal. We have argued and briefed matters in most (if not all) the California appellate districts, the California Supreme Court, the Ninth Circuit, as well as many of the other federal circuits. We are responsible for many appellate opinions affirming favorable decisions for our clients as well as overturning those decisions against our clients.

Real estate litigation. Our real estate litigation experience is extensive. We understand all areas of real estate. Title insurers hire us to represent their insureds (lender and property owners) in “major claims” involving multimillion-dollar disputes. Those same title insurers hire our team to defend them in the event of coverage/bad faith disputes. We also provide our real estate agents and service providers with defenses against common claims, including alleged non-disclosures and kickbacks.

Regulatory compliance and advice. We are recognized as a “go-to” firm for providing regulatory compliance advice and defense, particularly in unique areas of California law. For example, Hahn Loeser has addressed the following regulations that impact our clients—California’s Proposition 65, California’s Song-Beverly Credit Card Act, California’s Mercury Thermostat Collection Act, food safety and labelling, data privacy, Telephone Consumer Protection Act, Consumer Legal Remedies Act, Real Estate Settlement Practices Act, Fair Debt Collection Practices Act, and California’s Automatic Renewal Law.

We also counsel clients through the complexities of California’s labor and employment laws and represent business clients in compliance with the ADA, FMLA, CFRA, WARN and mini-WARN, ADEA, Older Worker Benefits Protections Act, Uniform Trade Secret Act, and the EEOC, DLSE, and NLRB enforcement manuals. Our trusts and estates group focuses on estate planning, wealth transfer and preservation, business succession planning, trust administration, probate, and probate litigation for both fiduciaries and beneficiaries.
