Producers of the Grand Theft Auto series of video games were found not liable for trademark infringement based on their depiction of an East Los Angeles adult nightclub called “the Play Pen” as an adult nightclub called “the Pig Pen” within the game. The Ninth Circuit affirmed the District Court’s decision that the creators of the game had a valid First Amendment defense.
